Products based on intellectual property (IP) such as movies, books and music are particularly vulnerable to piracy and counterfeiting. It is estimated that somewhere between US$150 - $200 Million is lost annually to piracy of African movies in the US. With unprecedented growth in African IP-based products, there is a need to protect intellectual property. IP is money! One cannot protect that right without asserting it. The simplest way to assert and protect that right (in the US) is to register the copyright.
This gives one (or a designated agent) the legal basis to stop counterfeit or pirated products, request enforcement action against infriging parties, and claim damages in Federal court. Most importantly, the registration (and publication) of a copyright acts as a deterrent in some instances to would-be pirates. (The African Copyright Registry provides a platform for the publication of copyrights and disemmination of that information to a wide audience thereby raising awareness and reducing the incidence of piracy.)
For authors and publishers in emerging markets to truly prosper, there must be a mechanism to stop the illegal reproduction of their material so as to enable royalties and sales revenues to flow back to the rightful owner. Export Path extends that mechanism to exporters. In addition to registering copyrights, Export Path also acts as a registered agent (in the US) on behalf of the copyright holder as it relates to the copyrighted material. The tailend of that relationship is the profitable sale of the copyrighted material which our core program (via Oyivo Exchange) does. Our partnership with the US Department of Commerce (Commercial Law Development Program) has enabled us to develop the framework required to act robustly in defense of copyrighted material coming through Export Path. The first step is copyright registration.
There are three levels of copyright registration service provided.
Aspire (Basic) Service Includes:
- Documentation and registration of the copyright in the US
- Copyright agency services for 1 year (renewable for a modest fee of $90 annually)
- Listing of copyright holder and copyrighted material in the African Copyright Registry (renewable for $25 annually)
- Cost: $450.00
Colonnade (Intermediate) Service Includes:
- Documentation and registration of the copyright in the US
- Copyright agency services for 1 year (renewable for a modest fee of $90 annually)
- Listing of copyright holder and copyrighted material in the African Copyright Registry (renewable for $25 annually)
- PLUS Review of copyrighted material for prospective sale in the US
- Cost: $750.00
Total Care (Advanced) Service Includes:
- Documentation and registration of the copyright in the US
- Copyright agency services for 1 year (renewable for a modest fee of $90 annually)
- Listing of copyright holder and copyrighted material in the African Copyright Registry (renewable for $25 annually)
- Review of copyrighted material for sale in the US
- PLUS Listing & sale of the product in the US via Oyivo Exchange (subject to appropriate quality & supply specifications)
- Cost: $950.00
